Defend-it Legal Services provides legal services for Landlord and Tenant Board matters involving Eviction For Use By Landlord, and other issues, as issues common to concerns governed by the Residential Tenancies Act, 2006S.O. 2006, Chapter 17.  With this said, sometimes when a dispute involves a residential landlord and tenant, certain issues must proceed at the Landlord Tenant Board.  The failure to bring specific issues into the proper forum may cause a dismissal the proceedings.  It is also possible that when a dispute is brought into the wrong forum, the right to a redo or a restart of proceedings in the proper forum is lost.  Accordingly, choosing the proper forum is imperative.  With other cases, such as commercial tenancy disputes, the issues are always beyond the jurisdiction of the Landlord Tenant Board and must be pursued in the Superior Court depending on the legal issues involved.
